Private Hire & HC Appeals

This course has been designed for local authority lawyers and licensing officers who prepare and present cases before the magistrates court and whose Council has adopted the provisions of the LGPA76.

This course will:

  • Deal with the powers that the Council has under the 76 Act to refuse, revoke and suspend licenses of drivers of hackney carriages and private  hire vehicles.
  • Cover recent case law
  • Follow a case study showing how cases can be used to support the Council’s decisions thus ensuring so far as is possible that the decision of  the Council is upheld

This course will cover in detail:

  • Principles of local authority decision making and appeals generally
  • Home office guidelines and the Council’s taxi licensing guidelines- the  standards to be set?
  • Initial steps in the appeals process and avoiding delay?
  • Preparing for the hearing  (cross examination, no case to answer and –  legal submissions) - case study
  • The hearing – which goes first and why - etc?
  • Use of case authorities and links to the facts of the case
  • Appeal dismissed and costs?
