Misconduct and the Code

The session will be of interest to all members, particularly members of Standards Committees, and to officers who deal with members or have responsibility for standards matters.
Leaving sufficient flexibility to allow for the outcome of the General Election, Peter Keith-Lucas’ intention is to cover not just the Code of Conduct but the wider issues around misconduct by elected members.
The Code itself is aimed at addressing the most important areas of misconduct, but it is not perfect and it does not cover every circumstance. If it remains, there needs to be a wider review than simply addressing the issue of whether and how it might apply to criminal conduct in members’ private lives. If it goes, there will remain the civil and criminal liability of members, powers of self regulation under R (Lashley) v Broadland DC, the Monitoring Officer’s powers under Section 5 of the 1989 Act, and Maladministration.
Using recent cases to illustrate the session, Peter Keith-Lucas will seek to cover the entire field of member misconduct in a seminar which will be of equal value to officers needing to address the issue and members seeking a deeper understanding of the Code and of alternatives to the Code.
