Agreements Under Sec 106 of the Town and Country Planning Act 1990 - Basic Survival Guide.

This day will be of interest to:

Planning Solicitors, Planning Committee Members, Planning Officers and Enforcement Officers with a basic or modest experience in section 106 agreements

  1. Decisions by the Planning Committee and by officers. When to delegate and when not. What can we do by planning condition? The need for a section 106 agreement. Planning obligations.
  2. The legal rules for section 106. Planning gain - its rules and boundaries. Execution of agreements. What do you expect to be in a section 106 agreement? Some practical situations.
  3. Layout and drafting. Parties, planning unit, area and common problems. Planning obligations and how to express them. Would an agreement of yours stand up in court?
  4. Drafting gone wrong? How to avoid problems. A drafting exercise. A chance to test yourself.
  5. Review of agreements. Modifications and discharge of planning obligations. Section 106A of the 1990 Act. Appeals under section 106B. Failures to comply with agreements and possible action. The evidence needed.
  6. Judging the developer and advisers. What are they trying to do? Pitfalls for the planning authority. Time limits. Some situations.
  7. The Planning Act 2008 and the future. When are the changes likely to happen? What will the role of the Secretary of State be? Your questions answered.
