Non School Attendance Prosecutions

The course concentrates on S444 Education Act 1996 as amended.

This is a course for:
Education Welfare Officers, Head Teachers who find themselves having to attend court and Local Authority Lawyers.

Investigators:
For the investigator it covers the basics on PACE interviews and evidence i.e what is admissible what isn’t, when and how to interview and what can be asked and by who at various stages of the pre-trial/investigation process. Statement taking is also covered by a much shorter, sharper approach enabling officers to cover the necessary ground in less time. Education welfare officers will also be shown how to make a presentation in court on a guilty plea and prove a case in the absence of the defendant, all in the minimal amount of time.

Head Teachers:
Head teachers will also benefit from knowing how to prepare for court, what questions they might be asked and what they can and cannot say in court.

Lawyers:
Whilst education prosecutions are relatively simple lawyers will require a greater knowledge of procedure and evidence to deal effectively with parents who change their story or fail to say why they are pleading not guilty. The course therefore covers the common situations that are likely to emerge in connection with these prosecutions and how to deal with them.

All delegates will be given the opportunity to ask any questions on evidence and procedure both in the investigation, preparation and advocacy stages at any time during the course.
