Mental Capacity Act 2005
Confused with capacity issues? How can you tell if someone has capacity or not? How will the courts treat a person who is said to lack capacity?
The law has always provided safeguards to protect those who may not have the legal capacity to enter into agreements, understand legal proceedings or understand how they are dealt with by courts or others in a legal setting.
This Course is aimed at any officer (housing, legal or other) who may have to deal with people who lack capacity and also what provisions there are to put in place powers of attorney and appoint deputies and advocates to assist. It will also look at practical examples of how to deal with people who lack capacity, any guidance issued and how the courts will treat people who lack capacity.
Topics to be covered will include:
- The definition of capacity.
- Powers of attorney.
- Appointment of deputies.
- Advance decisions to refuse treatment.
- The independent mental capacity advocate service.
- Changes to CPR 21 and how the courts in practice would treat a person who lacked capacity.
- Codes of Practice and guidance.
- The court of Protection.
- Practical case studies.
" Excellent - well done, well balanced and very informative - a must for all professionals "
